The case of a man accused of striking down a cyclist with a club was addressed in a Peterborough courtroom for the first time on Thursday.

David Fox, 65, of Inglewood Road, wasn’t in court but was represented by his lawyer John Whelton.

Fox is charged with aggravated assault and assault with a weapon following a July 18 incident on Erskine Avenue in the city’s south end which was caught on video. The viral video shows a man police identified as Fox beating a 74-year-old cyclist with a small club. A woman recording the video and several other witnesses halted the assault as the man left in his truck.

Peterborough police identified a suspect and later that day arrested Fox at his home.

Fox’s case was briefly addressed at Ontario Court of Justice and was held over until Sept. 22 as Whelton requested additional time to review the disclosure from the Crown.
