The Saskatchewan Party government fired board the chairman and two vice-chairs in 2008, shortly after winning the provincial election.

But the Saskatchewan Federation of Labour and two unions argued the government overstepped its boundaries when it appointed a new chair for the quasi-judicial board, which resolves labour disputes.
The Court of Queen’s Bench dismissed the union’s case and the union then went to the Court of Appeal.

The appeal court says in its decision that other board members had been appointed by the former government and that change is a political reality.
Labour Minister Don Morgan says he believes the new board has been impartial and its judgements well-reasoned.
